This workshop explores the legal and historical foundations of the Miranda Rights, a crucial component of the American criminal justice system. Participants will learn how constitutional protections under the Fifth, Sixth, and Fourteenth Amendments led to the landmark Supreme Court decision in Miranda v. Arizona (1966), and how that ruling continues to shape modern police procedure and defendants’ rights. This history will be used to inform the interpreter’s role in interpreting the Miranda Warning and to shape linguistically appropriate interpretations that are faithful to the broader legal intent of the Miranda Warning.
Educational Objectives:
Participants will be able to
- Describe the constitutional amendments that serve as the foundation for the Miranda Rights.
- Explain the significance of the Miranda v. Arizona case and its impact on criminal procedure.
- Identify key Supreme Court rulings that have refined or clarified the application of Miranda Rights since 1966.
